Video Release Terms & Conditions

1. Rights Granted
By submitting (“the Material”), I irrevocably grant the Producer and its assigns, licensees, and partners a non-exclusive, worldwide, perpetual, royalty-free licence to use, reproduce, adapt, edit, modify, dub, subtitle, exhibit, distribute, broadcast, stream, promote, market, and otherwise exploit the Material — in whole or in part — in any and all media now known or later devised, including but not limited to:

  • Theatrical, television, online, social media, and streaming platforms;
  • Publicity and promotional materials;
  • Merchandising, tie-ins, and derivative works.

This includes the right to crop, dub, subtitle, or otherwise modify the Material, and to combine it with other content for creative or promotional purposes.

2A. Ownership of the Material

I confirm that:

  • I am the sole owner and creator of the Material, or I have full legal authority to submit it and grant these rights.
  • The Material was filmed or created by me or under my direction.
  • No other person, company, or entity owns, controls, or has any claim to the copyright or other rights in the Material.
  • If the Material includes any third-party content (e.g. music, images, footage, trademarks, or performances), I have identified and obtained written permission from the rights holders and can provide copies upon request.

2B. User-Generated Content Restrictions

I understand and agree that:

  • The Material must not contain any licensed music, commercial soundtracks, or songs owned by record labels, publishers, or streaming platforms.
  • The Material must not include any visible branding, logos, trademarks, packaging, or advertisements (including on clothing or products) unless I own or have written permission to use them.
  • The Material must not feature any copyrighted video, TV, film, or online content displayed in the background.
  • I have checked and confirm that my clip is suitable for public broadcast and distribution without further permissions.

3. Use of Likeness & Animals

I consent to the use of my name, likeness, voice, image, and performance, as well as those of any person or animal depicted, without restriction.

I confirm I have obtained written consent from any identifiable person(s) appearing in the Material (and from parents/guardians of minors) and can provide it on request.

4. Music & Third-Party Material

I confirm that:

  • All music, sounds, and dialogue in the Material are either original, royalty-free, public domain, or fully licensed for commercial use.
  • If I composed or performed original music, I hereby grant the Producer the same perpetual rights to that composition and recording.
  • If any part of the Material is not wholly created by me, I have disclosed those elements and obtained all necessary permissions for their use.
  • The Material contains no unlicensed music, commercial tracks, or copyrighted content.
  • I will indemnify the Producer against any claims relating to music or other third-party elements contained in the Material.

5. Warranty & Moral Rights

I warrant that:

  • I am the rightful owner or authorised licensee of the Material.
  • The Material does not infringe any rights of any third party (including copyright, trademark, privacy, or publicity rights).
  • The Material contains no unlawful, defamatory, or obscene content.
  • I have not assigned these rights to any other party.

I waive (to the fullest extent permitted by law) any moral rights or similar rights I may have in the Material and consent to any use, alteration, or adaptation of the Material by the Producer. I agree not to assert any claim based on moral rights, defamation, or invasion of privacy arising from the Producer’s use, adaptation, or presentation of the Material.

6. Indemnity

I agree to indemnify and hold harmless the Producer and its affiliates, distributors, licensees, successors, and assigns from and against any claims, damages, or liabilities arising from or related to the use of the Material or breach of this agreement.

7. No Compensation

I acknowledge that submission is voluntary and unpaid. I understand that the Producer has no obligation to use the Material, and that no payment, credit, or royalties are due now or in the future unless otherwise agreed in writing.

8. Miscellaneous

  • The Producer may assign, sub-licence, or transfer its rights under this agreement.
  • I waive any right to inspect or approve the final version of the Material or its use.
  • This release is irrevocable and binding upon me and my heirs, executors, and assigns.
  • If any clause is deemed invalid, the remainder shall remain enforceable.

9. Governing Law

This release shall be governed by and construed in accordance with the laws of new South Wales, Australia
